Bakersfield, CA (October 27, 2024) – On the morning of Sunday, October 27, 2024, 17-year-old Jules Lilia Cortes of Hughson tragically lost her life after being struck by two vehicles in the 18000 block of Panama Lane in Bakersfield.
Accident Details: The initial investigation revealed that a westbound pickup truck struck Cortes as she was in the roadway outside of a crosswalk. The driver of the pickup truck remained at the scene and cooperated with law enforcement. However, as the driver called 911 to report the accident, a second vehicle—a sedan of an unknown make and model—ran over Cortes and fled the scene.
According to the Bakersfield Police Department, officers responded to reports of a crash involving a pedestrian at approximately 5:30 a.m. Upon arrival, they found Cortes suffering from major injuries. Unfortunately, the pronounced her deceased at the scene.
Investigation: The second vehicle’s driver did not stop to render aid, making this a hit-and-run incident. Authorities are urging anyone with information about this vehicle or its driver to contact the Bakersfield Police Department.
Legal Considerations: As a personal injury attorney, I find that several aspects of this case warrant further examination.
Liability for the First Vehicle: Drivers must drive safely and be cautious of any pedestrians, whether or not in the crosswalk. Investigators will determine whether the driver had adequate time to react and whether road conditions or visibility played a role.
Liability for the Second Vehicle: The second vehicle’s driver could face both civil and criminal liability, particularly for failing to stop and render aid as required by California law. Hit-and-run drivers often face severe consequences,as failing to stop demonstrates a lack of care for the health and safety of the victim.
Roadway Design and Maintenance: Pedestrian safety is often tied to the design and maintenance of the roadway. If Panama Lane lacked adequate lighting, signage, or pedestrian pathways, liability could extend to local government entities responsible for maintaining safe conditions.
Wrongful Death Claim: Depending on the invesigation findings, Cortes’s family may be able to file a wrongful death claim against the negligent parties. They may be able to recover compensation for funerale expenses and emotional distress. Even if the investigation finds Cortes was negligent for crossing the street outside the crosswalk, her familt may stillbe able to recover partial compensation under California’s comparative negligence laws.
I offer my deepest condolences to the family and loved ones of Jules Lilia Cortes during this heartbreaking time.
