Tragic Pedestrian Accident Claims Life of 81-Year-Old Leopoldo Barajas in Simi Valley 

Simi Valley, CA (June 18, 2024) – On Tuesday evening, June 18, 2024, a tragic accident occurred at the intersection of Ulysses Street and Socrates Avenue in Simi Valley, resulting in the death of 81-year-old Leopoldo Barajas. 

Accident Details: The incident was reported shortly after 5:20 p.m. by the Simi Valley Police Department. According to authorities, Barajas was crossing Ulysses Street in the marked crosswalk. At the same time, a BMW SUV was making a left turn from Socrates Avenue onto Ulysses Street. The BMW struck Barajas. Although he was promptly transported to a nearby trauma center, Barajas succumbed to his injuries. The driver remained at the scene.

Legal Considerations: As a personal injury attorney, I find that many aspects of this case warrant attention. Under California law, drivers must yield the right-of-way to pedestrians in marked crosswalks. Drivers must exercise due care to avoid colliding with pedestrians. Investigating whether the driver adhered to this requirement is crucial. Even in the absence of impairment, drivers must exercise caution, particularly when making turns at intersections. The design and maintenance of the intersection where the accident occurred are also critical factors. Poor visibility, inadequate lighting, or insufficient signage can contribute to accidents. If the intersection’s poor design is a contributing factor, there could be grounds for holding the municipality accountable for failing to maintain a safe pedestrian crossing. If negligence is found, such as driver or municipality negligence, the family of Leopoldo Barajas may be able to file a wrongful death claim and recover compensation for the death of their loved one.
