Lamorinda, CA (August 10, 2024) – Marcos Amaral, 30, of Antioch, tragically lost his life in a motorcycle collision on state Highway 24.
Accident Details and Investigation: The incident occurred around 12:05 a.m. east of Saint Stephens Drive, where Amaral’s motorcycle collided with a BMW SUV. Despite the best efforts of first responders, Amaral was pronounced dead at the scene.
The California Highway Patrol (CHP) reports that the driver of the BMW, who has not been named, was arrested on suspicion of DUI-related charges. The BMW driver was not injured in the collision. The CHP is continuing to investigate the circumstances surrounding the crash and is seeking witnesses. They encourage anyone with information to contact them.
Legal Considerations: As a personal injury attorney, I find that several aspects of this case warrant further examination. The fact that the BMW driver was arrested on suspicion of driving under the influence is a significant factor. The outcome of these DUI-related charges will play a crucial role in establishing fault. A conviction for DUI can strongly indicate negligence, which is a critical component in personal injury and wrongful death cases. Factors such as vehicle maintenance and road conditions will also be examined.
Beyond the criminal charges, Amaral’s family may be able to pursue a wrongful death claim. This civil action seeks to hold the responsible party financially accountable for their actions, compensating the victim’s loved ones for the emotional and financial impact of their loved one’s death. Such compensation can include loss of companionship, financial support, and funeral expenses.
I offer my deepest condolences to Marcos Amaral’s family during this challenging time.
