Kern County Pedestrian Accident Claims the Life of Michael Anthony Lorusso

Kern County, CA (December 6, 2024) – On Friday, December 6, 2024, Michael Anthony Lorusso, a 77-year-old man from Rosemead, was fatally struck by a vehicle while walking within the traffic lanes of Highway 99 near Highway 166. 

Accident Details: The accident occurred at approximately 6:10 a.m. when a 2021 GMC Yukon traveling southbound at around 75 mph collided with Lorusso. Despite the driver’s attempts, they were unable to avoid the collision. Authorities pronounced Lorusso dead at the scene, and the driver of the GMC remained cooperative during the investigation.

Legal Considerations: As a personal injury attorney, I find that several aspects of this case warrant further examination. Critical questions include why Lorusso was walking in the traffic lanes on a major highway and whether any external factors, such as poor lighting, roadway design, or vehicle condition, contributed to the accident.  

Additionally, California law requires drivers to exercise reasonable care to avoid hitting pedestrians, even in unexpected situations. Investigators will likely consider whether the driver was distracted or failed to respond appropriately.

Potential Wrongful Death Claim: If negligence is found to be the cause of the crash, Lorusso’s family may be able to file a wrongful death claim to seek compensation for their loss. Even if Lorusso is also found negligent for walking on the freeway, which pedestrians are not permitted to do, his family may still be able to recover if another party was also at fault.
