Joseph Michael Axiaq Fatally Struck by Train in Bakersfield

Bakersfield, CA (December 17, 2024) – The Kern County Coroner’s Office has identified Joseph Michael Axiaq, a 40-year-old Bakersfield resident, as the man tragically struck and killed by a train on December 17, 2024. 

Accident Details: The incident occurred at approximately 6:25 p.m. on Norris Road, west of the Knudsen Drive Overpass. Axiaq was pronounced dead at the scene, according to the coroner’s report.

Legal Considerations: As a personal injury attorney, I find that several aspects of this case warrant further examination. Fatal train accidents often raise questions about safety protocols, warning systems, and liability. Railroads are generally required to maintain proper signage, operational warning signals, and adequate visibility at crossings. The railway company could be held responsible if any of these elements were deficient or malfunctioning. Additionally, train operators must follow speed regulations and exercise caution, especially in areas with pedestrian traffic.

If the railway had prior knowledge of frequent pedestrian activity in the area, it might have been obligated to implement additional safety measures to prevent accidents. It is also essential to investigate whether the train crew took reasonable steps to avoid the collision once Axiaq was seen on the tracks, such as activating the horn or engaging the emergency brakes. 

Wrongful Death Claim: If it is determined that the railway company or train operator acted negligently, Axiaq’s family may have grounds to file a wrongful death claim. Compensation could cover funeral expenses, loss of financial support, and emotional suffering.
