Jose Regalado Jr. Identified as Pedestrian Killed on Highway 101

Santa Barbara County, CA (August 15, 2024) – On August 15, 2024, 30-year-old Jose Regalado Jr., a resident of Fillmore, was tragically struck and killed.

Accident Details: Regalado was struck when he was entering a vehicle on the shoulder of Highway 101, east of Gaviota. According to the Santa Barbara County Fire Department, bystanders immediately attempted life-saving efforts, including using an automated external defibrillator (AED). Despite these efforts, Regalado Jr. was pronounced dead at the scene. The driver involved in the collision remained on the scene and cooperated with authorities.

Legal Considerations: As a personal injury attorney, I find that determining liability is crucial in a case like this. The investigation would likely focus on several factors, including the visibility and actions of both the pedestrian and the driver, the location and condition of the vehicle on the shoulder, and whether any road or environmental conditions contributed to the tragedy.

California law requires drivers to exercise due care to avoid collisions with pedestrians, even if the pedestrian is not in a designated crossing area. Investigators will need to assess whether the driver was distracted, speeding, or otherwise negligent at the time of the accident. Additionally, the circumstances surrounding why Regalado was entering a vehicle on the highway shoulder may also be relevant in determining liability.

Depending on the outcome of the investigation, Regalado’s family may be able to file a wrongful death claim to recover compensation for the loss of their loved one.

My sincerest condolences are with the family and friends of Jose Regalado Jr. during this difficult time.
