José Gutiérrez Killed in Atascadero Hit-and-Run

Atascadero, CA (March 14, 2025) – A tragic hit-and-run crash on Friday claimed the life of 11-year-old José Gutiérrez.

Accident Details: José Gutiérrez was walking on the sidewalk along El Camino Real when a pickup truck veered off the road and struck him from behind. The driver fled the scene. Emergency personnel found José severely injured on the sidewalk. He died at the scene. After reviewing community-provided video footage, officers found a 2003 Ford F-150 abandoned behind an apartment building several blocks away. After further investigation, authorities arrested 31-year-old Zachary Bernal of Atascadero. Police announced that Bernal is expected to be charged with vehicular manslaughter while intoxicated and felony hit-and-run resulting in death or injury.

Legal Considerations: Investigators must examine several factors to identify the cause of the crash. Leaving the scene of an accident without stopping to help a critically injured victim is against the law. California law requires all drivers to stop, render aid, and report collisions involving injury or death. Further, authorities suspect Bernal was intoxicated at the time of the crash, which could significantly impact the case. Driving under the influence impairs judgment, slows reaction time, and increases the likelihood of fatal accidents.  

Investigation: Authorities will review the following to determine the full circumstances of the crash:

  • Toxicology reports to determine if Bernal was under the influence;
  • Surveillance footage showing the truck’s movements before and after the crash;
  • Witness statements from bystanders who saw the vehicle veer off the road; and
  • Vehicle damage analysis to match the Ford F-150 to the collision.

If driver negligence is confirmed, José’s family may have grounds to file a wrongful death claim to seek justice and financial relief for funeral expenses and emotional suffering.
