Huntington Beach, CA (September 30, 2024) – In the early hours of Monday morning, a tragic collision in Huntington Beach claimed the life of 51-year-old bicyclist Kristin Bellovich.
Accident Details and Ongoing Investigation: The crash occurred near Beach Boulevard and Glencoe Drive when a Ford Bronco, driven by 68-year-old Elias Madriz Gutierrez, struck Bellovich from behind. Gutierrez, an Orange resident, was arrested on suspicion of driving under the influence (DUI) and second-degree murder.
According to Huntington Beach Police, Gutierrez did not stop to assist Bellovich after the crash. Instead, he attempted to flee the scene but was quickly located and apprehended. His arrest marks yet another incident in his history of DUI-related offenses, as court records reveal prior DUI convictions in 2018 and 2009. Due to these previous convictions, prosecutors may seek to elevate charges from vehicular manslaughter to second-degree murder.
Legal Considerations: As a personal injury attorney, I find that several aspects of this case warrant further examination. Driving under the influence is generally considered negligence because it demonstrates a disregard for the safety and well-being of others on the road. By choosing to drive while impaired, the driver knowingly puts other people’s lives at risk.
In addition to criminal charges, Gutierrez may face civil liability. Bellovich’s family may be able to file a wrongful death lawsuit against him. Such a lawsuit would seek compensation for their losses, including emotional suffering and funeral expenses.
I offer my deepest condolences to Kristin Bellovich’s family and friends during this incredibly difficult time. I hope the investigation will provide them with the answers they need.
