Hit-and-Run at Escondido Intersection Claims Life of Pedestrian Miguel Leonides Garcia

Escondido, CA (September 17, 2024) – A tragic hit-and-run accident occurred at the intersection of Broadway and Mission Avenue in Escondido on Tuesday, resulting in the death of 58-year-old Miguel Leonides Garcia.

Accident Details: The incident occurred shortly after 6 a.m. as Garcia was crossing the street when he was struck by a white SUV described as an “off-road style” vehicle. The SUV, which featured a large spare tire and a red jack on its back, fled the scene, heading north on Broadway and later east on Lincoln Avenue. Garcia was transported to a local hospital by paramedics, but despite their efforts, he was pronounced dead soon after his arrival.

Legal Considerations: As a personal injury attorney, I believe that law enforcement should focus on identifying the fleeing driver in this situation.

First, video surveillance from nearby businesses or traffic cameras could help identify the SUV and driver. Witness accounts could also provide crucial details about the vehicle and its movements before and after the collision. Given that the SUV had unique features—a large spare tire and a red jack—law enforcement may be able to narrow their search based on these details.

If the driver is identified, their liability would likely extend to civil and criminal charges. Criminally, fleeing the scene of a fatal accident could lead to felony hit-and-run charges. On the civil side, the family of Miguel Leonides Garcia may have grounds for a wrongful death claim. This type of claim would seek damages for medical costs, funeral expenses, and the emotional toll the loss has had on Garcia’s family.

I offer my deepest condolences to Miguel Leonides Garcia’s family and friends during this incredibly difficult time.
