Hit-and-Run Crash Kills Peter Jun Ming Nip in Crescent City 

Crescent City, CA (December 4, 2024) – On December 4, 2023, 80-year-old Peter Jun Ming Nip was tragically killed in a hit-and-run collision at the intersection of Northcrest Drive and Madison Avenue in Crescent City.

Accident Details: The California Highway Patrol (CHP) reports that Nip was walking across a marked crosswalk while pushing a shopping cart when a 2019 Nissan Rogue struck him. The driver of the Nissan, identified as 33-year-old Alexandra Danielle Diehl, fled the scene. The crash occurred around 6 p.m. The initial collision caused Nip to be thrown into the southbound lane. 

Following this, a northbound Toyota 4Runner hit his shopping cart, and a third vehicle, a white Kia, swerved to avoid Nip but could not prevent further contact. Emergency responders transported Nip to Sutter Coast Hospital, where he succumbed to his injuries at approximately 9 p.m.

Investigation: The CHP investigation identified the suspect vehicle, and Diehl was arrested at 8:35 p.m. She faces charges of vehicular manslaughter, hit-and-run, and leaving the scene of an accident.

Legal Considerations: As a personal injury attorney, I find that several aspects of this case warrant further examination. The incident raises significant questions about driver negligence, particularly Diehl’s failure to yield to a pedestrian in a marked crosswalk. California law strictly requires drivers to stop for pedestrians in crosswalks. By failing to do so and fleeing the scene, Diehl likely violated multiple traffic laws, increasing her liability in criminal and civil proceedings.

Investigators will also examine whether the Kia driver’s actions contributed to Nip’s harm. Although the driver tried to avoid Nip, investigators will determine if distraction, speeding, or other factors contributed to the Kia driver’s inability to avoid Nip.

Wrongful Death Claim: Nip’s family may be able to pursue a wrongful death claim, seeking damages for loss of companionship, emotional distress, and funeral expenses.
