Santa Monica, CA (December 22, 2024) – On December 22, 2024, at approximately 6:40 p.m., Judy Mershon, an 85-year-old Army veteran, was fatally struck in a hit-and-run crash at the intersection of Wilshire Boulevard and Chelsea Avenue in Santa Monica.
Accident Details: The driver, later identified as 30-year-old Rod Sharif, allegedly struck Mershon with significant force, causing fatal injuries. Police arrested Sharif on December 27, 2024, using surveillance footage to track him down. While searching Sharif’s residence, authorities discovered a white Toyota Rav4 with substantial front-end damage.
Investigation: Sharif was booked on suspicion of murder and felony hit-and-run. Police reports indicate he has prior arrests for driving under the influence and reckless driving.
Mershon, who was battling dementia, was reportedly walking to church at the time of the crash. Friends and community members have called for enhanced lighting and crosswalk signals at the intersection to improve safety.
Legal Considerations: As a personal injury attorney, I find that this incident raises significant legal questions about liability. Driving under the influence is a grave act of negligence, as it impairs judgment, reaction time, and motor skills, significantly increasing the risk of fatal accidents. In addition to criminal charges, Sharif may face civil liability. Judy Mershon’s family may be able to pursue a wrongful death claim against Sharif.
The community’s call for enhanced safety measures, such as improved lighting and crosswalk signals, highlights potential municipal liability. If a history of similar accidents at the intersection exists, the city might share partial responsibility for failing to address known hazards.
My sincerest condolences are with the family and friends of Judy Mershon during this difficult time.
