Hit-and-Run Collision in Merced Kills Raul Alejo Valdivias

Merced, CA (July 13, 2024) – Raul Alejo Valdivias, 55 years old, was tragically killed in a hit-and-run collision on Saturday, July 13.

Accident Details and Ongoing Investigation: The incident occurred Saturday morning near La Mesa Court and Carmen Way. Valdivias was driving a Honda Civic westbound on Carmen Way. A Hyundai Tucson traveling north on La Mesa Street at a high rate of speed then struck Valdivias’s vehicle. Valdivias was pronounced dead at the scene. The alleged driver of the Hyundai, 35-year-old Jennifer Magana, fled the scene but was later apprehended that afternoon in Merced. She was booked into Merced County Jail on multiple charges, including felony driving under the influence, vehicular manslaughter with gross negligence, and hit-and-run resulting in injury or death.

Legal Considerations: As a personal injury attorney, I find that several aspects of this case warrant further examination. One of the primary factors in this case is the allegation of felony driving under the influence. DUI is a significant offense, and if proven, it demonstrates a blatant disregard for the safety of others on the road. Magana’s alleged impairment could be critical in establishing her liability for the accident. Beyond the criminal charges, Valdivias’s family may pursue a civil wrongful death claim against Magana. This claim could provide them with financial compensation for their loss, covering funeral expenses, loss of income, and emotional distress.

My sincerest condolences are with the family and friends of Raul Alejo Valdivias during this heartbreaking and challenging time.
