Bakersfield, CA (July 4, 2024) – On July 4, a tragic accident occurred on Highway 178, east of Beale Avenue, resulting in the death of 61-year-old Frank Julio Raygoza from Bakersfield.
Accident Details: Raygoza was struck by a vehicle in the evening while crossing the highway’s westbound lanes. A 29-year-old man from Bakersfield was driving when Raygoza ran directly into the path of his car. The driver was unable to avoid hitting Raygoza. The impact was fatal, and Raygoza was pronounced dead at the scene.
Legal Considerations: As a personal injury attorney, I find that several aspects of this case warrant further examination. First, investigators must determine why did Raygoza cross into the westbound lane. Next, they must look at the behavior of the driver. Was he impaired or distracted? Was he speeding? If so, these actions may indicate negligence. Also, investigators must examine the conditions of Highway 178 at the time of the accident. The lighting, visibility, and signage will be reviewed to determine if they played a role in the incident. Poor lighting or inadequate signage can contribute to accidents, possibly implicating the local municipality. Lastly, the vehicle should be examined to determine if a mechanical defect was why the driver could not avoid hitting Raygoza. If so, the vehicle manufacturer or service provider may be liable for the accident. Depending on the findings of liability, Raygoza’s family may be able to file a wrongful death claim. With this claim, they will be able to recover compensation for Raygoza’s death, including funeral and burial expenses, loss of income, and emotional distress.
My sincerest condolences are with the family and friends of Frank Julio Raygoza during this difficult time.
