Fresno County, CA (June 17, 2024) – A devastating accident involving a semi-truck and a Chevrolet resulted in the death of 53-year-old Consuelo Cordova De Hernandez from Riverdale.
Accident Details: The accident occurred around 1:20 p.m. on Monday at the intersection of Kamm and Jameson Avenue in Fresno County. Cordova De Hernandez was driving the Chevrolet. According to the California Highway Patrol (CHP), Cordova De Hernandez failed to stop at a posted stop sign, leading to a fatal collision with the semi-truck driven by a 70-year-old man. Unfortunately, Cordova De Hernandez died at the scene. The semi-truck driver sustained minor injuries. As a personal injury attorney, I find that several aspects of this case warrant examination.
Road Condition and Intersection Signage: One primary area of investigation would be to verify the visibility and condition of the stop sign at the intersection. The sign must be free of any obstructions or damages that might have prevented Cordova De Hernandez from seeing it. Also, poorly designed intersections or hazardous road conditions can sometimes play a significant role in such incidents. The municipality may be negligent for not maintaining adequate signage and safe roads.
Driver Behavior and Witness Statements: Gathering witness statements and any available dashcam or surveillance footage is essential to understanding the actions of both drivers leading up to the collision.
Vehicle Condition and Maintenance Records: Examining the maintenance records of both the Chevrolet and the semi-truck could provide insights into whether mechanical failures played a role in the accident. Regular maintenance logs and any past issues with the vehicles should be scrutinized. If a mechanical problem was the reason Cordova De Hernandez did not stop, then car manufacturers or maintenance providers may be potentially liable.
Comparative Negligence Law: California follows the doctrine of comparative negligence. So even if Cordova De Hernandez failed to stop at the stop sign, her family may still be able to file a wrongful death claim if another party also had liability.
My sincerest condolences go to the family and friends of Consuelo Cordova De Hernandez during this tragic time.
