San Bernardino, CA (July 4, 2024) – A tragic accident occurred early on the morning of July 4th when a pedestrian, 46-year-old Gumercindo Huerta of San Bernardino, was struck by a vehicle on the Route 210 Freeway.
Accident Details and Investigation: The incident took place at approximately 4:55 a.m., and Huerta was pronounced deceased at the scene by the San Bernardino County Sheriff Coroner’s Division. The California Highway Patrol (CHP) is currently investigating the circumstances surrounding this fatal accident.
Legal Considerations: As a personal injury attorney, I find that several aspects of this case warrant further examination. The investigators will scrutinize the actions of the driver who struck Huerta. What was their speed? Were they distracted or impaired? Any violation of traffic laws or failure to exercise due care could be significant factors. It is also essential to understand why Huerta was on the freeway and his actions leading up to the accident. Was he attempting to cross the freeway, and if so, why? Were there contributing factors, such as poor visibility or lack of pedestrian pathways? The freeway conditions at the time of the accident, including lighting and road signage, will also be examined. Any road maintenance or signage deficiencies that might have contributed to the accident could point to the liability of the local municipality. Depending on the outcome of the investigation, Huerta’s family may be able to file a wrongful death claim.
My sincerest condolences are with the family and friends of Gumercindo Huerta during this challenging time. I hope they get the support they need.
