Livermore, CA (June 13, 2024) – A devastating accident claimed the life of 27-year-old Merced resident Miguel Bernardino when he lost control of his motorcycle on Interstate 580 and was struck by a big rig.
Accident Details: The accident occurred in the morning. Bernardino was traveling west on his Suzuki on the I-580. While driving at high speeds, Bernardino was lane-splitting when he lost control of his motorcycle. He was thrown from his motorcycle and struck by an oncoming truck tractor-trailer vehicle. Tragically, Bernardino died at the scene. CHP officers interviewed the truck driver.
Investigation: The investigation into the crash continues. It is not clear why Bernardino lost control of his motorcycle. As a personal injury lawyer, I find several aspects of this case warrant examination.
Comparative Negligence: Bernardino was reported to be traveling at a high rate of speed. Investigators will need to examine whether his speed was excessive and if it contributed to the loss of control. Speed analysis can involve reviewing traffic camera footage, witness statements, and data from any onboard motorcycle telemetry. Even if Bernardino is found to be negligent, his family can still recover compensation by filing a wrongful death claim if other third parties also share responsibility for causing the accident.
Road Conditions: The condition of the roadway, including any potential hazards or defects, will need to be assessed. Poor road conditions can contribute to motorcyclists’ loss of control. The local authority charged with maintaining the roads may be liable if there are hazards or defects.
Big-Rig Driver’s Actions: Analyzing the truck driver’s reaction time and whether they took appropriate evasive actions can provide insights into the accident dynamics. The driver’s account and possible dashcam footage from the truck will be essential pieces of evidence. Further, ensuring that the truck driver complied with all relevant traffic laws and regulations at the time of the accident is crucial.
Mechanical Failure: Investigators should consider whether Bernardino’s motorcycle had a mechanical failure that contributed to the accident. This investigation may involve a detailed examination of the motorcycle’s maintenance records and a forensic analysis of its components.
I offer my condolences to Miguel Bernardino’s family and friends during this incredibly difficult time.
