Nipomo, CA (September 24, 2024) – A tragic motorcycle accident claimed the life of 37-year-old Nipomo resident Levi Lopez on Tuesday afternoon near Nipomo.
Accident Details: The crash occurred around 4:15 p.m. at the intersection of Hutton Road and Joshua Street. According to the California Highway Patrol, Lopez was riding his Harley-Davidson motorcycle northbound on Hutton Road when a Nissan pickup truck traveling southbound attempted to make a U-turn in front of him. Lopez was ejected from his motorcycle upon impact with the truck’s passenger side. Sadly, despite wearing safety gear, Lopez succumbed to his injuries at the scene. The truck’s driver, 36-year-old Genaro Cortez Beltran of Bakersfield, allegedly fled the scene with the truck’s occupants. However, an off-duty CHP officer quickly apprehended them. Authorities do not believe drugs or alcohol played a role in the incident.
Legal Considerations: As a personal injury attorney, I find that several aspects of this case warrant further examination.
U-Turn: A U-turn maneuver requires drivers to ensure the road is clear and will not impede oncoming traffic. Beltran’s failure to do so could make him liable for the crash. Investigators will examine the factors surrounding Beltran’s decision to turn to determine if he was negligent.
Attempt to Flee the Scene: Another critical factor is the driver’s attempt to flee the scene. Hit-and-run behavior can have significant legal consequences and potentially add criminal charges and civil liability.
Wrongful Death Claim: The family of Levi Lopez may be able to file a wrongful death lawsuit against Beltran, seeking compensation for their tragic loss. A wrongful death claim could provide the family with financial relief for funeral costs, lost income, and emotional suffering.
I offer my deepest condolences to the family and friends of Levi Lopez during this incredibly difficult time. I hope that the family receives the support they need as they navigate the aftermath of this heartbreaking loss.
