San Luis Obispo County, CA (July 23, 2024) – On the early morning of July 23, 2024, a tragic head-on collision on Highway 46 near Highway 41 claimed the lives of Helmut Stich, 83, and Karen Stich, 72, both of Paso Robles.
Accident Details: The California Highway Patrol (CHP) reported that the couple was driving a Hyundai westbound on Highway 46 East when the fatal crash occurred. According to the CHP, Helmut Stich was driving the Hyundai at approximately 55 mph when he attempted to pass a tractor-trailer. As he maneuvered into the eastbound lane to overtake the big rig, the Hyundai collided head-on with a Ford F350 driven by Grant McKenzie from San Diego. McKenzie sustained significant injuries and was transported to Adventist Health Sierra Vista Hospital in San Luis Obispo. Helmut and Karen Stich died at the scene. Impairment is not suspected to be a factor.
Legal Considerations: As a personal injury attorney, I find that several aspects of this case warrant further examination. California law requires drivers to exercise caution when passing other vehicles on two-lane roads. The maneuver must be executed safely without causing danger to oncoming traffic. Investigators must review whether Helmut Stich’s attempt to overtake the truck followed these safety regulations. Was there sufficient visibility and road space to safely complete the pass?
California follows the doctrine of comparative negligence. Even if Helmut was negligent in attempting to pass the truck, his family might still be able to recover if another party shared liability.
Investigators will also examine the road conditions, the behavior of the Ford driver, and whether any of the vehicles suffered from mechanical failure. Depending on the outcome of the investigation, Stich’s family may be able to file wrongful death claims.
My sincerest condolences are with Helmut and Karen Stich’s family and friends during this difficult time.
