Turlock, CA (June 8, 2024) – On Saturday afternoon, a tragic head-on collision claimed the lives of 25-year-old Turlock resident Dominique Cardenas and 36-year-old Modesto resident Jesus Hernandez-Perez. The California Highway Patrol (CHP) reported that the car accident occurred around 4 p.m. on Geer Road, just south of Grayson Road.
Incident Details: Cardenas was driving a 2013 Lexus southbound on Geer Road when she crossed the double yellow lines into the northbound lane. Her vehicle collided head-on with a 1996 Toyota driven by Hernandez-Perez. Both drivers, who were wearing their seat belts, died at the scene.
Investigation: As a personal injury attorney, I believe this case should be closely examined. The CHP’s initial investigation suggests that alcohol is expected to be a factor in the crash. Confirming whether alcohol was involved is crucial because driving under the influence of alcohol raises questions of breach of duty and negligence.
Legal Considerations: Liability for DUI-related crashes typically falls on the intoxicated driver. If one of the drivers was under the influence and their intoxication was found to have caused the accident, their estate could be held responsible for the wrongful death of the other. Additionally, violations of the California Vehicle Code are a breach of duty and can give rise to these claims. Recovery may include funeral and burial expenses, loss of income, and loss of affection.
My sympathies to the families and loved ones of Dominique Cardenas and Jesus Hernandez-Perez during this difficult time. I hope further investigation brings clarity to the facts of the case.
