Fontana, CA (September 4, 2024) – A devastating collision on Wednesday in Fontana has tragically claimed the life of Richard Pshock, 64, a veteran on his way to a VA appointment.
Accident Details: The accident occurred at the intersection of Beech and Cherry Avenues. According to reports, the crash unfolded when Noe Armando Banuelos, 32, sped away in a Jeep Cherokee from a traffic stop on the 15 Freeway after officers discovered he had a federal arrest warrant. While attempting to evade law enforcement, Banuelos exited the freeway and ran a red light, slamming into Pshock’s Mustang. The accident was captured on dashcam footage. Both vehicles were sent careening across the street.
Sadly, Pshock lost his life at the scene. Banuelos attempted to flee on foot but was apprehended by officers and taken to Arrowhead Regional Medical Center for treatment of his injuries. Later, Banuelos escaped from the hospital but was re-arrested.
Legal Considerations: As a personal injury attorney, I find that several aspects of this case warrant further examination. This tragic incident presents grounds for both criminal and civil liability. Noe Armando Banuelos’ actions—speeding, running a red light, and fleeing from law enforcement—may result in serious criminal charges.
From a civil perspective, Banuelos’ decision to flee and speed through an intersection may be considered negligence. His disregard for public safety, especially while evading officers, strengthens the case for Pshock’s family to pursue a wrongful death claim. Such a claim would allow the family to seek compensation for their profound loss, including funeral expenses, loss of companionship, and the emotional trauma caused by this tragedy.
My deepest condolences go out to the family and friends of Richard Pshock during this challenging time.
