Apple Valley, CA (June 29, 2024) – On Saturday, a tragic accident occurred in the Town of Apple Valley, resulting in the death of 29-year-old Daniel Stuardo Perez.
Accident Details: A San Bernardino County Sheriff’s Deputy was responding to a priority call with emergency lights and sirens activated. Perez was traveling eastbound on Bear Valley Road when he attempted to turn left into a parking lot. This maneuver caused him to collide with the patrol vehicle. Sadly, Perez was pronounced deceased at the scene. The deputy involved sustained non-life-threatening injuries and was transported to a local hospital for treatment. His name has not been released.
Investigation: The Apple Valley Police Department is seeking additional information from the public regarding this incident.
Legal Considerations: As a personal injury attorney, I find that several factors in this case warrant further examination. Examining whether the deputy had the right-of-way given the emergency response situation is essential. Emergency vehicles with lights and sirens are generally prioritized, but other drivers must also adhere to specific rules. Analyzing traffic signals and any possible traffic control devices at the intersection will be necessary. Understanding Perez’s actions leading up to the collision is critical. Investigators must determine if he was aware of the approaching emergency vehicle and whether his left turn was executed following traffic laws. Investigators must also assess whether the deputy adhered to departmental protocols for responding to emergencies, which can impact the determination of liability. Proper training and protocol compliance are essential for minimizing risks during emergency responses. Depending on the findings of the investigation, Perez’s family may be able to file a wrongful death claim against the San Bernardino County Sheriff’s Department.
My sincerest thoughts are with Daniel Stuardo Perez’s family and friends during this difficult time. His family has set up a GoFundMe account to help with expenses. Please contribute if you can.
