Kern County, CA (November 13, 2024) – On November 13, 2024, a two-vehicle crash at Weedpatch Highway (Highway 184) and East Fairview Road in Kern County claimed the life of 31-year-old David P. Marquez Jr. of Lamont.
Accident Details: The California Highway Patrol (CHP) reported that the collision occurred around 9:03 p.m. A 2013 Freightliner pulling two tank trailers was turning northbound onto Weedpatch Highway at approximately 15 MPH. At the same time, Marquez Jr.’s 2005 Nissan Murano was traveling northbound on Weedpatch Highway at an undetermined speed. The Nissan collided with the left side of the Freightliner’s first tank trailer. Tragically, Marquez Jr. was pronounced dead at the scene.
Investigation: The Freightliner’s driver remained at the scene and cooperated with investigators. Authorities have not determined whether alcohol or drugs contributed to the crash. The CHP is continuing its investigation, and additional details may clarify liability. Anyone with information is encouraged to contact the CHP.
Legal Considerations: As a personal injury attorney, I find that this tragic incident raises critical questions about liability and safety practices on the road.
- Negligence in Turning Movements: The Freightliner’s slow turn across the highway may warrant scrutiny. Did the driver signal and yield to oncoming traffic properly? If the driver failed to adhere to traffic regulations or assess the timing of the turn adequately, this could point to negligence.
- Commercial Vehicle Responsibility: Liability may extend to the company employing the driver if inadequate training, vehicle maintenance, or safety policies are discovered.
- Poor Road Conditions: Investigators should also examine the road’s condition. Issues like inadequate signage, poorly maintained pavement, or obstructions could have contributed to the collision. If it is determined that local or state agencies responsible for maintaining the roadway failed to address hazardous conditions, they may be liable.
Wrongful Death Claim: David Marquez Jr.’s family may consider pursuing a wrongful death claim if evidence suggests negligence by the Freightliner driver, the trucking company, or other parties. This claim could compensate his family for funeral expenses, loss of financial support, and non-economic damages, such as loss of companionship and emotional distress.
Comparative Fault: The speed of the Nissan Murano remains under investigation. If Marquez is found to have been driving at high speeds, his family’s ability to recover compensation would not necessarily be barred. However, it may be adjusted based on California’s comparative negligence laws.
I offer my sincerest condolences to David Marquez Jr.’s family and loved ones as they navigate this difficult time.
