Sonoma County, CA (June 27, 2024) – On the early morning of Thursday, Alejandro Moya Benitez, a 27-year-old resident of Sonoma, tragically lost his life in a crash on Old Adobe Road at Casa Grande Road.
Accident Details: Benitez was driving south in a BMW on Old Adobe Road. He attempted to pass a Cadillac traveling ahead of him by crossing over the double-yellow line. During this maneuver, the right back of Benitez’s BMW collided with the left front of the Cadillac. This impact caused him to lose control of the vehicle, which subsequently veered off the roadway and collided with a tree. Benitez was pronounced dead at the scene. The crash resulted in major injuries to a passenger in the BMW, who was immediately transported to a hospital for urgent medical care. The driver of the Cadillac was not injured.
Investigation and Legal Considerations: In the aftermath of this tragic incident, the California Highway Patrol (CHP) called for anyone with information regarding the crash to contact the Santa Rosa CHP office. As a personal injury attorney, I find that several aspects of this case warrant further examination. One key issue is establishing who is liable for the crash. Since Benitez was attempting to pass another vehicle by crossing the double-yellow line, his maneuver might initially suggest fault. However, the full circumstances surrounding the incident need a thorough examination. It is crucial to determine if any external factors, such as road conditions, visibility, or actions by the Cadillac driver, played a role in the collision. Depending on the findings of the investigation, Benitez’s family may be able to file a wrongful death claim. The injured passenger may be able to file a personal injury claim.
My hearts go out to the family and friends of Alejandro Moya Benitez and the injured passenger during this incredibly difficult time. I wish the injured individual a speedy recovery.
