Taft, CA (July 15, 2024) – Clinton James Baer, a 53-year-old resident of Taft, was tragically killed in a collision with a car early on July 15.
Accident Details: According to the Kern County Coroner’s Office, the accident occurred around 1 a.m. on Highway 33, just south of Cadet Road. Baer was riding his bicycle northbound on the highway when he was struck by a vehicle also traveling northbound. The collision resulted in Baer’s death at the scene.
Legal Considerations: As a personal injury attorney, I find that several aspects of this case must be investigated to uncover the truth about this fatal accident, including the following:
- Driver Identification and Responsibility: Identifying the driver involved in the collision and determining their actions leading up to the accident is crucial in establishing liability. Was the driver distracted, under the influence, or otherwise negligent? Was the driver speeding or engaging in other reckless behavior?
- Road and Traffic Conditions: Examining the road conditions and traffic patterns at the time of the accident can provide context. Was there adequate lighting? Were there any obstructions or road hazards that could have contributed to the collision?
- Bicycle Visibility and Safety Measures: It is critical to determine if Baer had appropriate lighting and reflective gear on his bicycle to ensure visibility. If not, this negligence may have contributed to the accident. However, this would not necessarily deprive his family of the opportunity to recover compensation for his death.
The California Highway Patrol’s ongoing investigation will be critical in answering these questions. Depending on the outcome, Baer’s family may be able to file a wrongful death claim.
Our thoughts and deepest sympathies go out to Clinton James Baer’s family and friends during this incredibly difficult time.
