Fatal Bicycle Accident in Alamo Kills Allison Merkle

Alamo, CA (October 9, 2024) – On Wednesday, October 9, 2024, 45-year-old Allison Merkle of Walnut Creek was tragically killed in a collision while biking on Livorna Road under the Interstate 680 overpass, according to the California Highway Patrol (CHP). 

Accident Details: The accident occurred around 11:12 a.m. when a man driving a black Toyota, parked on the right shoulder of the road, re-entered Livorna Road and struck Merkle. Emergency responders arrived at the scene, but unfortunately, Merkle was pronounced dead. The driver of the Toyota was uninjured, and the cause of the accident remains under investigation. No arrests have been made as of yet.

Driver Negligence: As a personal injury attorney, I find that a critical aspect of the investigation will likely center around whether the Toyota driver was negligent when pulling back into the roadway. Drivers are responsible for checking for cyclists and other road users before re-entering traffic. If it’s found that the driver failed to yield to Merkle properly, he may be deemed at fault for the accident. 

Wrongful Death: In this case, Merkle’s family may have grounds to pursue a wrongful death claim. If the investigation determines that the driver’s actions were negligent, the family could seek compensation for their loss, including funeral expenses, loss of companionship, and emotional suffering.
