Encinitas, CA (January 19, 2025) – Authorities are investigating a tragic hit-and-run crash that claimed the life of Emily Hernandez, 66, last weekend.
Accident Details: The accident occurred on North Coast Highway 101 near Jasper Street. According to preliminary information from the San Diego County Sheriff’s Department, a gray-colored SUV struck Hernandez while she was in the roadway. The driver fled the scene without stopping to render aid.
Good Samaritan Peter Leisher, who arrived shortly after the incident, described seeing bystanders around the victim. Leisher and others attempted to save Hernandez by administering CPR until paramedics arrived. Despite their efforts, Hernandez was later pronounced dead at a local hospital.
Investigation: Authorities are urging anyone with information about the driver or vehicle involved to contact the San Diego County Sheriff’s Department or Crime Stoppers.
Legal Considerations: As a personal injury attorney, I find that several aspects of this case warrant further examination. Fleeing the scene of a fatal accident is a serious crime under California law. The driver has violated the duty to stop, render aid, and report the accident.
The family of Emily Hernandez may pursue a wrongful death lawsuit against the driver if identified. Such a claim could seek compensation for funeral expenses, loss of companionship, and the emotional trauma caused by her death.
We extend our deepest condolences to the family and loved ones of Emily Hernandez.
