Electric Scooter Rider Killed in San Jose DUI Hit-and-Run Crash

San Jose, CA (August 3, 2025) — A man riding an electric scooter died Monday from injuries sustained in a hit-and-run DUI crash that occurred Saturday evening in San Jose.

Incident Details: According to the San Jose Police Department, the crash occurred around 5 p.m. on August 2, when the victim was traveling westbound in the bike lane of Capitol Expressway near Tuers Road. A 2005 Chevy Astro, driven by 36-year-old Luis Cruz Martinez, veered into the bike lane and struck the scooter rider before fleeing the scene. Officers apprehended Martinez nearby and arrested him on suspicion of DUI and felony hit-and-run. The victim was hospitalized with life-threatening injuries and died two days later.

Investigation and Legal Considerations: Authorities are thoroughly investigating the recent collision, examining road conditions, driver conduct, and other potential contributing factors to determine the sequence of events and prevent future incidents.

Pending the investigation’s findings, the victim’s family may be entitled to pursue a wrongful death claim to compensate them for the loss of their relative, assist with funeral costs, and other damages.
