Fresno, CA (May 21, 2024) – A tragic incident occurred in downtown Fresno on Tuesday morning when a 21-year-old local man was struck and killed by a train, as confirmed by the Fresno County Coroner’s Office.
Incident Overview: The deceased was identified as Eddy Rodriguez of Fresno. The accident took place near the intersection of Tulare and Q Street, close to Fresno City Hall, at around 11:30 a.m. According to reports from the police, Rodriguez was riding his bike across the tracks when the train, despite sounding its horn, was unable to stop in time to avoid the collision. It remains unclear whether Rodriguez saw or heard the train approaching.
Legal Implications: Fresno police are currently investigating the circumstances leading up to the accident, including examining whether visibility issues or distractions may have played a role. This investigation will also review the safety measures in place at the crossing to determine if enhancements are needed to prevent future incidents. Depending on the outcomes of the investigation, there could be implications regarding railway safety protocols and the setup of the crossing where the accident occurred. If negligence is found in the setup and maintenance of the crossing or the operation of the train, there may be grounds for wrongful death action by Rodriguez’s family.
My deepest sympathies go out to the family and friends of Eddy Rodriguez during this incredibly difficult time. I hope that the investigation reveals more information about the cause of this collision.
