DUI Crash in Orange Kills Mother and Injures Daughter and Two Others

Orange, CA (September 29, 2024) – On the evening of Sunday, September 29, 2024, a devastating accident occurred at the intersection of Tustin Street and Collins Avenue in Orange, resulting in the death of 40-year-old Maria Minerva Arroyo-Lozada and critical injuries to her daughter and two others. 

Accident Details: The crash happened around 8 p.m. when 18-year-old Roberto Noe Monfil-Xitlama, driving a Chevy Equinox, reportedly ran a red light while heading south on Tustin Street. His vehicle collided with a westbound Toyota RAV4 on Collins Avenue. Arroyo-Lozada, her daughter, her boyfriend, and a 13-year-old girl were in the Toyota.

The crash tragically claimed the life of Arroyo-Lozada at the scene. Her daughter, initially in critical condition, was later upgraded to serious. Arroyo-Lozada’s boyfriend and the 13-year-old passenger also sustained serious injuries and remain hospitalized.

Investigation: Monfil-Xitlama, who allegedly had a blood-alcohol content more than twice the legal limit, was arrested and booked on suspicion of gross vehicular manslaughter while intoxicated.

Legal Considerations: As a personal injury attorney, I find that this accident raises several critical legal questions. One key focus for investigators will be whether Monfil-Xitlama’s blood-alcohol level was significantly over the legal limit. In addition to criminal charges, he can also face civil claims. Driving under the influence typically constitutes negligence. Monfil-Xitlama’s decision to drive while intoxicated put the safety of others at risk, breaching his duty to drive with reasonable care.

Civil Claims: Maria Minerva Arroyo-Lozada’s family might be able to file a wrongful death lawsuit and pursue compensation for their loss. Her daughter and the other passengers may also have grounds for personal injury claims, seeking compensation for medical expenses, pain and suffering, and long-term care needs stemming from this catastrophic event.
