Ontario, CA (December 24, 2024) – On Christmas Eve, a fatal collision occurred on Bon View Avenue in Ontario involving an alleged DUI driver.
Accident Details: Aaron Kleibacker, 39, an LAPD officer, was driving southbound around 7:37 p.m. when his vehicle struck bicyclist Fabio Cebreros, 38, of Chino. Kleibacker fled the scene but later returned. A sobriety test reportedly indicated he was above the legal alcohol limit. The bicyclist was transported to a hospital but succumbed to his injuries. Kleibacker was arrested and booked at the West Valley Detention Center in Rancho Cucamonga on charges of vehicular manslaughter. He was released on Christmas Day.
The Los Angeles Police Department confirmed Kleibacker is still employed and assigned to the Rampart Division. As a probationary officer, he could be dismissed without the ability to challenge his termination through a board of rights hearing. The investigation into the incident is ongoing, with potential charges pending against Kleibacker.
Legal Considerations: As a personal injury attorney, I find that several aspects of this case warrant further examination. Kleibacker could face significant criminal charges. In addition, he may also face civil liability. Driving under the influence (DUI) is a clear act of negligence, as it demonstrates a reckless disregard for the safety of others on the road. Even though he returned, it must be noted that fleeing the scene shows a failure to take responsibility for the harm caused. These actions could allow Ceberos’s family to file a wrongful death lawsuit. California’s laws allow victims’ families to seek compensation for damages, including funeral expenses, loss of financial support, and emotional suffering.
My sincerest condolences are with the family and friends of Fabio Cebreros during this difficult time.
