DUI Crash on Cherokee Lane Claims Life of 71-Year-Old Michael Vargas

San Joaquin County, CA (July 11, 2024) – A tragic incident took place on Cherokee Lane at Elm Street in Lodi, resulting in the death of 71-year-old Michael Vargas. 

Accident Details and Ongoing Investigation: Vargas, who appeared to be an unsheltered individual, was struck and killed by a Ford Explorer while attempting to cross the street in his wheelchair around 9:40 p.m. The driver of the Ford Explorer, identified as 49-year-old Lucas Suarrez Ramos, was arrested at the scene. Ramos faces several serious charges, including driving under the influence, DUI causing great bodily injury, and gross vehicular manslaughter while intoxicated. He is currently being held on $1.56 million bail at the San Joaquin County Jail and has already appeared in court for arraignment.

Legal Considerations: As a personal injury attorney, I find that several aspects of this case warrant further examination. 

  • Driver’s Behavior: Given Ramos’s arrest on suspicion of DUI, a thorough investigation into his blood alcohol content (BAC) at the time of the accident is essential. Law enforcement will need to gather evidence to determine if his intoxication directly contributed to the collision. 
  • Roadway Conditions and Visibility: The conditions of Cherokee Lane and Elm Street at the time of the accident will also be critical in understanding the events leading up to the collision. Factors such as street lighting, visibility, and traffic signals can all play a role. It is crucial to assess whether the crossing area was adequately marked and whether any obstructions might have contributed to reduced visibility for both Vargas and Ramos.
  • Pedestrian Safety Measures: The fact that Michael Vargas was in a wheelchair raises concerns about pedestrian safety measures in place for individuals with disabilities. Investigators must examine whether the crosswalks and sidewalks in this area are compliant with federal and state laws.

The first factor considers Ramos’s negligence, while the last two consider the negligence of the local municipality. Depending on the investigation’s findings, Vargas’s family may be able to file a wrongful death claim against the negligent parties to recover compensation, such as funeral and burial expenses.
