DUI and Hit-and-Run Collision in Apple Valley Kills John R. Akers

Apple Valley, CA (November 4, 2024) – On November 4, 2024, at approximately 3:52 PM, 23-year-old motorcyclist John R. Akers of Hesperia was struck and killed by an intoxicated driver.

Accident Details: The accident occurred at the intersection of Bear Valley Road and Iroquois Road in Apple Valley. The driver, 30-year-old David Richard Rolph of Apple Valley, was driving a Hyundai Genesis eastbound in the left turn lane. Akers was traveling westbound on his Harley Davidson motorcycle in the number one lane. According to officials, Rolph made an unsafe left turn, which caused him to broadside the motorcycle. Rolph reportedly fled the scene after the collision, abandoning his vehicle. He was later apprehended by law enforcement. Unfortunately, medical personnel pronounced Akers dead at the scene.

Investigation: Rolph was charged with various offenses, including hit and run, DUI causing bodily injury, and vehicular manslaughter.

Legal Considerations: As a personal injury attorney, I find that several aspects of this case warrant further examination. Hit-and-runs and driving while intoxicated, while criminal offenses, can also implicate negligence, exposing Rolph to civil liability.

  • DUI Offense: The investigation revealed that Rolph, allegedly under the influence of alcohol, made an unsafe left turn that led to the broadsiding collision with Akers’ motorcycle. DUI offenses resulting in bodily injury or death carry severe legal consequences, as it breaches the duty to drive safely.
  • Hit-and-Run: California law imposes a legal duty on drivers to remain at the scene, particularly when bodily injury or death occurs, and to call law enforcement and provide aid. Leaving the scene can compound the legal ramifications, especially in cases involving fatalities, as it often suggests a willful disregard for the victim’s life.
  • Road and Intersection Conditions: Although DUI and hit-and-run offenses are central to the investigation, it may also consider factors like visibility, intersection safety, and traffic light timing on Bear Valley Road. Analyzing these conditions could reveal whether any additional roadway hazards contributed to the collision.

Wrongful Death Implications: The death of John Akers raises the potential for a wrongful death claim by his family. In California, family members can pursue compensation for their emotional loss and financial damages following the wrongful death of a loved one.

The tragic and untimely loss of John Akers has deeply affected his family and the community. His father, Robert Akers, described John as a beloved son, brother, and friend known for his kindness, thoughtfulness, and love of music and motorcycles. My thoughts are with John’s loved ones during this difficult time.
