Clovis, CA (September 18, 2024) – On September 18, 2024, Robby Pokorny, 63, of Fresno, was critically injured in a bicycle collision at Clovis Avenue and Saginaw Avenue in Clovis.
Accident Details: According to the Clovis Police Department, Pokorny was riding his bike around 1 p.m. when he was struck by a van traveling north on Clovis Avenue as he crossed the road. Despite receiving medical attention, Pokorny sadly succumbed to his injuries nearly two weeks later on September 30. The van’s driver remained at the scene and fully cooperated with law enforcement. At this time, the cause of the crash remains under investigation by the Clovis Police Department.
Legal Considerations: As a personal injury attorney, I find that several aspects of this case warrant further examination. Investigators will likely focus on critical areas to determine whether negligence played a role in Robby Pokorny’s tragic death:
- Driver Behavior: The driver’s attentiveness and actions at the time of the crash will be scrutinized. Investigators will determine whether the driver was distracted, speeding, or acting recklessly.
- Crosswalk and Road Design: Investigators will also examine whether Pokorny was crossing at a marked crosswalk or another designated crossing area. Poorly designed intersections or the absence of pedestrian/cyclist signage could contribute to accidents like this one. Road design issues that make it harder for drivers to see cyclists or that fail to protect vulnerable road users could also be significant factors.
- Pedestrian and Cyclist Safety Measures: The presence (or lack) of appropriate safety measures for cyclists—such as bike lanes, warning signs, and signals—will be examined. If the area had known safety issues or lacked adequate protections for cyclists, the municipality or those responsible for road safety may bear some liability.
- Mechanical Failure: Both the vehicle and the bicycle will likely be inspected for any potential mechanical issues that could have contributed to the crash. A mechanical failure might shift liability toward a third party, such as a manufacturer or repair shop.
Given the limited information, the results of the investigation will help determine if there is sufficient evidence to pursue a wrongful death lawsuit. Pokorny’s family could have grounds for a claim if negligence is found to have caused the accident.
I extend my heartfelt condolences to the family and friends of Robby Pokorny during this time of grief.
