Bakersfield, CA (December 10, 2024) – On December 10, 2024, 38-year-old Brent Evans was tragically killed in a collision on Airport Drive and Washington Avenue in Bakersfield.
Accident Details: According to the California Highway Patrol (CHP), Evans fell off his bicycle outside a crosswalk around 7:30 p.m. and was struck by an oncoming vehicle. Unfortunately, Evans died.
Legal Considerations: As a personal injury attorney, I find that several aspects of this case warrant further examination.
- Driver Behavior: California drivers have a duty to operate their vehicles safely and remain alert to avoid collisions, even if a bicyclist or pedestrian is outside of designated areas. Investigators will examine the facts to determine if the driver was distracted, speeding, impaired, or otherwise negligent.
- Road Conditions: Poor lighting conditions on Airport Drive may have contributed to the crash. Both witnesses and authorities have noted that this area is poorly lit, creating dangerous conditions for pedestrians, cyclists, and drivers alike. If it is determined that inadequate street lighting contributed to the accident, the local municipality may bear responsibility for failing to provide and maintain safe road infrastructure.
The family of Brent Evans may have grounds to pursue a wrongful death claim if negligence is confirmed to be the cause of the crash. With this claim, they may be able to recover funeral expenses, loss of financial support, and emotional distress.
My sincerest condolences are with Brent Evans’s family and friends during this difficult time. A GoFundMe campaign has also been created to assist with funeral and burial expenses. Please contribute if you can.
