Bakersfield Hit-and-Run Kills Antonio Enrique Arjona

Bakersfield, CA (March 29, 2024) – The Kern County Coroner has identified Antonio Enrique Arjona, 41, as the pedestrian killed in a hit-and-run accident on Buck Owens Boulevard on March 29, 2024.

Accident Details: The collision occurred around 9:20 p.m. in the 3200 block of the street, with Arjona reportedly walking in the northbound lanes outside a crosswalk. Floyd Luster, 61, was reportedly driving a white hatchback northbound at the time of the collision. Emergency responders pronounced Arjona deceased at the scene. After the incident, Luster fled the scene. Following an investigation by the Bakersfield Police Department, aided by information from the Kern County Sheriff’s Office, Luster was located and arrested on January 9, 2025. He faces charges of felony hit-and-run and is currently held at Lerdo Jail.

Legal Considerations: As a personal injury attorney, I find that several aspects of this case warrant further examination. Hit-and-run accidents carry severe legal implications in California. By fleeing the scene, Luster violates the obligation to remain and assist the injured. Luster’s alleged actions expose him to significant criminal liability. In addition to the criminal case, civil liability may arise. Drivers must exercise due caution to avoid endangering pedestrians. Luster’s failure to fulfill this duty and subsequent decision to flee the scene could support a negligence claim. Investigators will also examine environmental factors such as lighting, road conditions, and whether speed or driver impairment contributed to the crash. This comprehensive analysis will determine the full scope of responsibility.

Wrongful Death Considerations: Arjona’s family may have grounds to pursue a wrongful death claim against Luster. California law allows surviving family members to seek damages for their loss, including funeral costs, loss of financial support, and emotional distress.  Even though Arjona may be found negligent for crossing outside a crosswalk, this does not excuse Luster’s potential negligence. However, any potential recoverable compensation may be reduced per Arjona’s portion of fault based on California’s comparative negligence laws.
