Phelan, CA (June 7, 2024) – A 20-year-old Phelan man, Michael Allen Stroup Jr., was tragically killed in a crash between his all-terrain vehicle (ATV) and an SUV along Highway 138 on Friday, June 7.
Accident Details: Stroup was riding a 1994 Honda ATV south of Phelan. Around 1 p.m., he reached Highway 138 between Rancho Del La Garto and Kruse Drive. As he attempted to cross the highway, he was struck by a 2024 Nissan Rogue traveling eastbound at approximately 70 mph. Despite the SUV driver’s attempt to brake and swerve to avoid the collision, she could not prevent the crash. Stroup was thrown from his ATV and later succumbed to his injuries at Arrowhead Regional Medical Center in Colton. The driver of the SUV, a 46-year-old woman from San Jose, sustained minor injuries.
Investigating Liability: As a personal injury attorney, several aspects of this case deserve a close examination. The speed of the SUV driver in comparison to the traffic and road conditions, the highway signage, and the drivers’ responses to the accident are all considered. Depending on the results of the investigation, there may be legal consequences, such as Stroup’s family bringing a wrongful death claim. The California Highway Patrol’s San Bernardino Office continues to investigate the collision and urges anyone with information to contact CHP Officer D. Eason at (909) 383-4247.
My condolences to the family and friends of Michael Allen Stroup Jr. I hope further investigation can determine the cause of the accident. A GoFundMe.com page has been established to help the family with funeral costs. Please contribute if you are able.
