Alleged DUI Crash Kills Sequan McKensie Taylor and Kayla Marie Smith in Monterey County 

Monterey County, CA (February 4, 2025) – A tragic crash on Highway 101 near Jolon Road claimed the lives of Sequan McKensie Taylor, 35, of Tacoma, Washington, and Kayla Marie Smith, 27, of Spanaway, Washington.

Accident Details: The crash occurred late Tuesday night, around 11:47 p.m., and involved a U-Haul van driven by Anthony Harvey, 38. According to the California Highway Patrol (CHP), Harvey was driving a 2023 Ford Transit U-Haul van southbound at approximately 65 miles per hour when he lost control, causing the van to veer off the roadway. The vehicle overturned down a steep embankment and came to rest on its wheels. Heavy rain was reported at the time of the crash.

The van was carrying three passengers, none of whom were wearing seatbelts. The two rear passengers, Taylor and Smith, were lying on a mattress in the cargo area and sustained fatal blunt force trauma. The front passenger suffered major injuries.

Investigation: CHP officers reported that Harvey was allegedly found to be under the influence of drugs and was booked into Monterey County Jail after receiving medical treatment. He is facing multiple charges, including murder, DUI causing bodily injury, possession of a controlled substance, and and possession of unlawful paraphernalia. His bail was set at $2,005,000.

Legal Considerations: As a personal injury attorney, I find that several aspects of this case warrant further examination. Driving under the influence (DUI) generally constitutes negligence because it impairs reaction time, judgment, and motor coordination, all of which are critical to safely operating a vehicle. In hazardous conditions like heavy rain, impairment further reduces a driver’s ability to maintain control and react to unexpected road changes, heightening the risk of severe crashes. 

The families of Sequan McKensie Taylor and Kayla Marie Smith may be able to pursue wrongful death claims. The injured front passenger may bring a personal injury claim for damages. Although the passengers were not wearing seatbelts, which may be considered comparative negligence, this would not necessarily bar recovery altogether. It may, however, reduce the compensation by the percentage of fault attributed to their actions.
